Trump loses sanctuary city fight with Chicago

  • Chicago has emerged successful in its lawsuit against the Trump administration for attempting to withhold federal grant funds from sanctuary cities. 
  • The 7th Circuit Court of Appeals ruled on Thursday that the administration’s threat to withhold public safety grants based on federal immigration policy was an overstep in its authority. 
  • Chicago, a city that refuses to cooperate with federal immigration agents, sued the administration in 2017 when it first tried to make the funds contingent on adhering to immigration policy. 

The Trump administration cannot withhold grant money from cities that refuse to cooperate with federal immigration authorities, an appeals court ruled Thursday.

President Donald Trump’s threat to withhold public safety grants from jurisdictions that don’t cooperate with Immigration and Customs Enforcement (ICE), otherwise known as “sanctuary cities,” violates the Constitution’s separation-of-powers provisions, the 7th U.S. Circuit Court of Appeals ruled. The decision was the latest in the ongoing court battle between the Trump administration and the city of Chicago.

The executive branch’s authority on immigration policy does not include withholding funds from cities that were allocated from the legislative branch, the appeals court found.

“Such a concentration of power would allow tyranny to flourish, and our system of government is wisely set up by the Founders to foreclose such a danger,” wrote Judge Ilana Rovner, writing on behalf of the three-judge panel, in a 95-page ruling.

“The separation of powers is a foundation of our government, not a formality to be swept aside on the path to achieving goals that the executive branch deems worthy,” Rovner continued. “Rather than an exercise of authority granted to it by the legislature, the conditions imposed here are an executive usurpation of the power of the purse.”

The court battle dates back to 2017, when the Department of Justice (DOJ) moved to withhold Edward Byrne Memorial Justice Assistance Grants from Chicago — a city that for years has refused to honor ICE detainer requests, share information, or otherwise cooperate with immigration agents. Then-Mayor Rahm Emanuel sued the DOJ in response.

Chicago Mayor Lori Lightfoot, Rahm’s successor and another major opponent of Trump’s immigration agenda, celebrated the court’s decision.

“When I got the news from our corporation counsel earlier this morning, I let out a cheer,” Lightfoot said, according to CBS Chicago. “This is a great victory, not only for Chicago, but for our immigrant and refugee communities everywhere in the country.”

The grant money at stake was a mere fraction of 1% of Chicago’s budget, but the drawn-out court fight indicated that the lawsuit was much more for Chicago leaders than receiving federal funds.

The Justice Department has the option of appealing the decision to the Supreme Court, where the administration has enjoyed more success with challenges to its immigration agenda, but it’s not clear yet how the DOJ will proceed.

Lightfoot is proud of Chicago’s status as a sanctuary city, and her administration has specifically instructed local law enforcement not to work with ICE agents in many circumstances. The city does not honor ICE detainer requests, and has even allowed illegal aliens charged of heinous crimes to walk free without notifying the agency — which has led to some gruesome consequences.

Chicago authorities, for example, refused to honor an ICE detainer request on an illegal alien in June 2019, and instead released him back into the public. That individual went on to allegedly sexually assault a toddler in a public bathroom.

In response to public backlash over the alleged assault, Lightfoot put blame back on ICE.

“They’re critical because we have said very clearly we are a welcoming city, a sanctuary city,” she said in February in response to accusations that her government could’ve prevented the crime. “Chicago Police Department will not cooperate with ICE on any immigration-related business.”

    Definitely throw it to the United States Supreme Court. Enough of pandering to the Illegals. These lower courts will side with the Illegals because they have all taken marching orders from Democrat’s who want to base their decision on feelings rather then rule of law.

    The appeal to the supreme court should already be in the process of being filed.
    I find it completely amusing that the circuit courts will uphold this, (of course they are liberals) but deny appeal from General Flynn (I know that was not the 7th court) or any one that has been screwed by the liberal justice system. It is the law of the land the constitution that these city and state administers swear an oath to uphold. Immegration is federal government not city or state. The law states if ICE issues a detainer that the state/city is obligated to inform and hold that individual.

    Does not the law preventing states from developing laws in direct violation of Federal law not apply here???

    I fail to see, or support, federal taxes being used to support programs in direct defiance of federal law. Hope this decision is fought all the way to SCOTUS! We the People shouldn’t have to finance illegal activities by openly obstructive states!

    May the city and all its suburbs now be overrun by gangs and local criminals. I will no longer read the regular weekend media reports of people shootings nor will I feel any sympathy for those impacted. The citizens and politicians there always look the other way and let the idiotic mayors, etc, that they elect do nothing to fix the plight.

Then we’ll see if they have the spine to follow through on this disastrous policy. How many victims do members of a community need suffer because of policies that favor illegal aliens over citizens in the name of progressive political grandstanding.

These cities aid and abet criminals, and should be treated as criminals. Put them in a cell with a bunch of illegal criminals and see how they like it if they survive. Time common sense and the law took over the country.

Sanctuary Cities and States where they are only Protecting Criminals and Illegal Immigrants Has To Be Unlawful !!!!! There is no other way to explain such Unjust Ruling even within 95 pages !!!!! This issue of Sanctuary Cities and States Must find it,s way the the Supreme Court, Hoping they have the proper Legal Mind Set !?!?!

    President Trump wasn’t the only one harmed. The Rule of Law was also ignored by the useless verbal copulation of the 7th circus. The Immagration policy of the United States is based upon immigration law. This is federal law, and is not subject to state by state interpretation. Therefore, any local or state immigration policy cannot be in violation of federal law. The asinine state of Illinois and the idiots who run Chicago are being allowed to act as though they are an independent country. This decision by a group of dope smoking, anti-establishment socialists masquerading as legal experts is a slap in the face to all intelligent Americans.

    Things had better change, or there will be an armed revolution in our future. The leftist, shadow government faithful must be eliminated by any means necessary, because you better believe that is their design for us and the United States of America.

    This is wrong in so many ways. At what point did the mayor, decide that she did not have to follow the law. At what point did they decide that criminals should be protected over legal Americans. At. what point did they decide that it was OK to set criminals loose on society.. we’re they not elected to serve the population, not criminals. Were they not elected to us hold our constitution? For any crime committed by these illegal criminals, they should be charged with aiding and awaiting them.

    Another IDIOT ruling but a liberal. A “Grant” by definition is a gift, that comes with conditions. You meet the conditions, you can qualify for the grant. If you do not meet them, then you forfeit the grant. SIMPLE, even a democrat could understand it, if he wanted to.

    Years ago i use to think about visiting Chicago , sounded very busy with many opportunities , however in the past few years it would never be a place I’d want to be . A friend of mine also transferred there for work and he had family there , needless to say he was back here Virginia within the year . I’m sorry for the people who have to live there and did’nt vote for these people, many just can’t pick up and leave that easily…In my opinion , I think that people who offer these sanctuary cities are just looking for extra money from agency’s , including the Govt. , they blame the govt ..when things go wrong , and have no regard for the safety or needs of the people they are really suppose to be there for . The fact they change the rules and just overlook ICE who is there to bring law and order is inexcusable and I feel if Trump has to honor this than ICE should be enforced there whatever the cost LAW IS LAW , and anyone who interferes no matter their status will be held accountable for their actions ! That’s the way we do it in the USA !

    Any ruling challenged to the Supreme Court where the ruling changes these judges decisions their districts need a three strikes and you’re out rule!

The reasoning: The DoJ is responsible for issuing the grants and, therefore, sets the criteria for granting the money. Since sanctuary cities are in defiance of immigration law, why are they entitled to the money? Why is the separation of powers an issue? The DoJ is carrying out laws enacted by the legislative branch. It doesn’t make sense. What is the government ‘s recourse if violating the law is okay. I don’t get it.

    Take the case to the supreme court. The Constitution gives the Federal Government full control of immigration policy. When the states establish either the entire state or selected cities as sanctuary areas, the are usurping Federal authority. I think the supreme court has already over ruled another ruling of another District Court of Appeals on the same subject. Liberal courts, like liberal politicians are ruining this country and making it unlivable, unless you happen to be an illegal immigrant.
